This is the full Terms of Use, Risk Warning, Liability Waiver, Release and User Acknowledgement that you accept in the FlightX app. It covers the same agreement shown and accepted on sign-in · nothing here is separate from what the app asks you to agree to.
These Terms of Use, Risk Warning, Liability Waiver, Release and User Acknowledgement (Version 1.3, effective 8 July 2026) are a legally binding agreement between you and Equipoised Enterprises Pty Ltd (ABN 49 692 667 986), an Australian proprietary limited company trading as FlightX, of 32A Aldinga Beach Road, Aldinga Beach, South Australia 5173 (contact: hello@flightxapp.com).
By creating an account, accessing the FlightX application, using any FlightX feature, uploading data, viewing educational material or analytics, receiving AI-assisted debriefs, recording or reviewing a jump, importing GPS or flight data, participating in any FlightX progression pathway, or tapping "I Agree", you confirm that you have read, understood and agreed to these Terms. If you do not agree, you must not use FlightX.
Skydiving, parachuting, canopy flight, canopy piloting, landing, high-performance landings, swooping, freefall, aircraft exit, canopy deployment, canopy control and all related activities are inherently dangerous and may result in serious injury, permanent disability, paralysis, psychological trauma, property damage, or death.
FlightX is an education, logging, progression, data-review and information tool ONLY. FlightX is NOT: • a parachuting instructor, canopy coach, drop zone safety officer, chief instructor or governing body • a manufacturer, certified altimeter, certified aviation instrument or safety device • a substitute for professional instruction, pre-jump briefings, emergency procedures or personal judgment • a substitute for compliance with the rules of your drop zone, national skydiving body, civil aviation authority, equipment manufacturer, coach, instructor, or local law.
You must never rely on FlightX as your sole or primary source of safety-critical information.
You acknowledge and agree that skydiving and canopy flight involve obvious, inherent, significant and unavoidable risks, including but not limited to: aircraft emergencies; exit instability; freefall collision; loss of altitude awareness; hard openings; premature deployments; parachute malfunctions; reserve parachute use; canopy collisions; incorrect pattern selection or landing direction; turbulence, wind shear, dust devils, rotor and thermals; downwind, crosswind, off-drop-zone, water and tree landings; obstacle, building, vehicle and powerline impact; landing injuries; high-speed canopy impact; incorrect flare timing; incorrect riser, toggle or harness input; misjudged turn initiation; low turns and hook turns; high-performance landing and swooping errors; equipment failure; packing errors; weather changes; human error; misinterpretation of data; over-reliance on technology; and failure of mobile devices, GPS, sensors, batteries, networks, Bluetooth, cloud services, software or third-party devices.
You voluntarily accept all risks associated with using FlightX in connection with skydiving, parachuting, canopy flight or any related activity.
You acknowledge that parachuting, skydiving, canopy piloting, canopy control, landing, high-performance canopy flight and related activities are dangerous recreational activities and that participation may involve risk of serious injury or death.
FlightX may be used in connection with activities supplied by third parties — drop zones, instructors, coaches, riggers, parachute associations, aircraft operators, equipment manufacturers and event organisers. FlightX does not control those third parties and is not responsible for their acts, omissions, advice, training, supervision, equipment, facilities, aircraft, weather decisions, operational decisions, safety systems or emergency procedures.
FlightX does not guarantee that use of the app will make you safer, prevent injury or death, improve your canopy skills, landing accuracy or swoop performance, correct your judgment, detect unsafe conduct, technical or sensor errors, environmental hazards or flight phases, or provide complete or accurate altitude, GPS, speed, descent, glide, turn, recovery-arc, landing or approach information.
You remain solely responsible for your own decisions, actions, preparation, training, equipment checks, emergency procedures, canopy choices, flight plan, altitude awareness, traffic awareness, landing pattern, landing area selection, and compliance with applicable rules.
All FlightX content — including canopy progression content (CFX tiers SPARK through PHOENIX), AFF-related content, Canopy Passport content, logbook content, jump analytics, GPS tracks, altitude graphs, phase detection, landing analysis, pattern visualisations, progression tiers, AI-generated or AI-assisted debriefs, Coach Apex responses, swoop analytics, competition-style scoring previews, and comparisons with previous jumps, other pilots or historical data — is provided for general educational and informational purposes only.
FlightX content must not be interpreted as personalised professional instruction unless expressly provided by a qualified human instructor or coach acting independently of FlightX.
Before making any skydiving, canopy, landing, equipment, progression, downsizing, high-performance landing, swooping, training or emergency decision, you must rely on: your qualified instructor or canopy coach; your chief instructor or safety officer; your drop zone's rules; your national skydiving organisation's rules and manuals; civil aviation regulations; manufacturer manuals and service bulletins; rigger advice; and your own training, judgment and real-time observations.
Where FlightX information conflicts with any of these, the external safety authority takes priority. FlightX must never be used to override, replace or contradict such guidance.
You must not interact with FlightX in a way that distracts you during aircraft boarding, climb, exit preparation, exit, freefall, deployment, canopy flight, pattern entry, final approach, landing or emergency situations.
Unless FlightX expressly releases a certified and legally approved real-time feature for a specific purpose, FlightX is intended for pre-jump preparation and post-jump review. You must not rely on FlightX during a jump for: altitude awareness; deployment, breakoff, pattern or turn-initiation altitudes; emergency procedures; landing direction or clearance; traffic separation; flare timing; swoop gates; weather, wind, equipment or go/no-go decisions.
FlightX may use phone sensors, GPS, barometric pressure, accelerometer data, imported flight files, third-party devices, manually entered information and other data sources. These systems may be inaccurate, delayed, unavailable, corrupted or incomplete — causes include GPS signal loss, poor satellite geometry, device placement, body position, cabin pressure changes, barometric drift, weather and temperature changes, hardware limitations, battery-saver modes, OS and background restrictions, Bluetooth or third-party device failure, cloud sync delay, import and manual-entry errors, algorithmic classification errors, map tile errors, software bugs, network failure, calibration error, and failure to record or detect the full jump or its phases.
FlightX analytics are estimates only. They must not be treated as exact, certified, complete, or safety-critical.
Any FlightX altitude calculation — including any feature described as TrueAlt, sensor fusion, GPS/barometric fusion or phase-aware altitude — is an estimate only. It is not a certified altimeter and must not be used as your primary, secondary or emergency altimeter. You must use approved, properly maintained and properly configured skydiving altimeters and audible altitude devices where required.
FlightX GPS tracks and maps are for review and education only. They must not be used for real-time navigation, aircraft navigation, landing-area selection, obstacle avoidance, traffic separation or emergency decision-making. Map tiles, satellite imagery, landing areas, DZ boundaries, hazards and overlays may be incomplete, outdated, misaligned or inaccurate.
FlightX may attempt to identify jump phases (climb, exit, freefall, deployment, canopy flight, approach, landing) and to visualise patterns, approaches, accuracy, descent rate, heading or glide. These labels and reviews are estimates for post-jump education only and may be wrong. They must not be treated as a definitive judgment that your flight was safe or unsafe.
High-performance canopy flight, intentional turns, front-riser approaches, harness turns, carving approaches, speed/distance/accuracy rounds, competition gates and swooping are extremely dangerous. FlightX does not authorise, approve, recommend or certify any user to perform high-performance landings.
You must only perform high-performance manoeuvres under appropriate qualified coaching, at suitable locations, in suitable conditions, on suitable equipment, within the rules of your drop zone and governing body. FlightX analytics must never be used as permission to downsize, increase turn size, lower initiation altitude, increase speed, attempt gates, or perform more aggressive manoeuvres.
Any AI-generated, AI-assisted, template-generated or automated debrief is informational only. AI outputs may be wrong, incomplete, outdated, misleading, overconfident, or based on incomplete data. You must not rely on AI debriefs for safety-critical decisions. Review all AI-assisted coaching language against qualified human instruction before applying it.
Parachute Passport and gear features may record canopy model, serial numbers, dates of manufacture, line-set information, jump and flight-hour counts, environment exposure, reserve repack dates, container and AAD details, ownership history and notes. FlightX does not verify equipment data and is not a rigger, manufacturer, maintenance authority, certification body or inspection service.
You must not rely on FlightX to determine whether any parachute, container, reserve, AAD, lines, risers, harness or component is airworthy, legal, safe, maintained, serviceable, suitable, or due for retirement. Line-set and canopy condition indicators (including any combination of jump numbers, flight hours and environment exposure) are informational estimates only — your rigger and the manufacturer's service requirements are the only authorities on airworthiness and replacement.
Any reminder FlightX shows or sends about reserve repack dates, AAD battery or service dates, line-set wear or other maintenance is a convenience feature only. Reminders may be missed, delayed, suppressed by your device, or based on incorrect user-entered dates. Your rigger's log, your AAD manufacturer's service schedule and your federation's rules are authoritative — never jump equipment because FlightX failed to warn you, and never delay maintenance because FlightX has not yet reminded you.
FlightX operates a Canopy Registry: a record of a canopy's service history kept against the canopy itself, not against you, so that a future owner, buyer or rigger has a starting point on a wing's provenance and the sport has a shared record of canopy service and safety. Keeping this de-identified canopy record is part of how the Canopy Passport works and is not optional. FlightX collects and retains it as reasonably necessary to provide the Canopy Passport, and in the legitimate interest of FlightX, canopy manufacturers and the wider sport in canopy airworthiness and safety.
When you record a canopy that has a serial number, FlightX adds that wing's de-identified service history to the Registry. A Registry entry can include the make, size, date of manufacture, a line-set timeline and a repair timeline, and a flag showing whether a rigger signed off on an entry. Before an entry is created, FlightX removes your identity, the rigger's name and the rigger's signature, so the Registry holds the wing's service history, not a record of the people who touched it. FlightX does not verify Registry entries and does not represent any entry, or any canopy, as verified, current or complete. A rigger-signed flag records only that a rigger attested to an entry at that time. It is not a FlightX verification and is not proof that a canopy is airworthy today.
The Canopy Registry is separate from your jump and flight data. You can choose whether FlightX uses your jump and flight telemetry to develop and improve FlightX, as described in the Privacy Policy, and that choice does not affect the Canopy Registry. The Canopy Registry is operated by Equipoised Enterprises Pty Ltd (ABN 49 692 667 986).
You are solely responsible for: obtaining proper training; holding required licences, qualifications and ratings; following all drop zone, governing body and civil aviation rules and manufacturer instructions; maintaining and checking equipment; checking weather and winds; assessing landing areas; maintaining altitude and traffic awareness; planning your pattern; executing emergency procedures; deciding whether to jump, deploy, land, perform or avoid any manoeuvre, downsize, or rely on any information; verifying the accuracy of all app data; using appropriate physical and electronic altimeters; avoiding device distraction; and ensuring your device is secure and does not create a snag, drop, distraction or entanglement hazard.
You must not use FlightX: as a certified aviation instrument, altimeter replacement or emergency device; as a substitute for instruction; to justify or pressure others into unsafe behaviour; to coach others unless qualified; to encourage unqualified users to downsize or swoop; for real-time jump decisions; to operate or navigate aircraft; to violate drop zone, governing body or civil aviation rules; to upload false, misleading or fraudulent data; to impersonate another jumper, coach, instructor, rigger or official; to harass, shame, defame or endanger another user; to reverse engineer, copy, scrape or misuse FlightX systems; to interfere with FlightX security; or while under the influence of alcohol, drugs, fatigue or any condition that impairs judgment.
FlightX may display courses, tiers, progression pathways, completion markers, badges, jump bands, analytics, checklists and learning material. Unless expressly stated in writing by an authorised human instructor, coach, governing body or certification authority, FlightX does not issue official skydiving or canopy qualifications, licences, ratings, endorsements, coach or instructor sign-offs, DZ permissions, competition approvals or equipment approvals. Any FlightX badge, tier, completion marker, metric or achievement is an app-based informational marker only.
FlightX does not provide medical, psychological, physiological, fitness, rehabilitation, trauma, concussion, mental health, fatigue-management or injury-prevention advice. Seek appropriate professional advice before participating in skydiving or canopy flight if you have any medical, physical, psychological or fitness concern.
Any weather, wind, density altitude, turbulence, cloud, temperature, forecast or environmental information shown in FlightX is informational only. Conditions change rapidly. Verify conditions through approved local sources, drop zone staff, pilots, instructors, coaches and your own observations. FlightX is not responsible for any decision made based on weather or wind information.
FlightX may integrate with or import data from third-party services or devices (including GPS devices, wearables, FlySight, Garmin, Apple, Android, map providers, Firebase, cloud services, AI providers, app stores, payment processors and analytics tools). FlightX does not control third-party services and is not responsible for their data accuracy, availability, failures, bugs, terms, privacy practices, changes, outages, sensor limitations, or maps and imagery. Your use of third-party services may be governed by separate terms.
FlightX uses Google Analytics (GA4) to collect anonymised usage data: app events such as logging a jump or opening a feature, device type, operating system and app version, session length, and an approximate region inferred from your IP address. This is used to understand which features pilots use and to find and fix bugs. It does not include your name, and you can limit it through your device privacy settings.
If you join the Test Pilot Program and switch on 'Share recording data' in Settings (off by default), FlightX also uploads the full-resolution sensor track for each jump you record, including 5 Hz barometer, motion and precise GPS samples. This opt-in telemetry is used only to measure and improve recording accuracy, is stored against your account only, and is never sold or published. You can switch it off at any time to stop all future uploads.
Transactional and program emails, such as address verification and Test Pilot invitations, are sent through Brevo. Brevo processes your email address and delivery events under its own privacy terms and does not use your data for advertising. Full detail is in the FlightX Privacy Policy.
FlightX is built with open-source software components, each licensed to you under its own licence terms rather than under these Terms. A full list of these components and their licences, including the complete licence texts, is available in the app under Settings, Legal, Open Source Licenses.
One of these components is FFmpeg, used for on-device video processing on mobile and provided under the GNU Lesser General Public License version 3.0 (LGPL-3.0). The complete source code for the version of FFmpeg used in FlightX, and any information needed to obtain or replace it as required by that licence, is available on request by emailing hello@flightxapp.com.
Nothing in these Terms limits, overrides or removes any right granted to you under those open-source licences. To the extent anything in these Terms conflicts with an open-source licence that applies to a component, that open-source licence governs your use of that component. In particular, and despite anything to the contrary in the Intellectual Property section below, you may modify, reverse engineer, decompile and relink any such component to the extent that its open-source licence expressly permits you to do so.
You are responsible for the accuracy of information you enter — including name, licence details, jump numbers, canopy model and size, wing loading, container, reserve and AAD details, line-set data, repack dates, drop zone, aircraft, weather, training history, coach details, witness verification, equipment ownership and jump notes. FlightX is not liable for harm caused by inaccurate, incomplete, outdated or misleading user-entered information.
If FlightX allows you to share jump data, canopy data, badges, analytics, maps, screenshots, debriefs, leaderboards or comparisons, you are responsible for what you share. You must not share content that encourages unsafe conduct, misrepresents ability, defames, reveals private information without consent, breaches drop zone or competition rules or confidentiality, infringes intellectual property, or creates a safety risk. FlightX may remove content it considers unsafe, unlawful, misleading, abusive, defamatory, infringing or inconsistent with these Terms.
To the maximum extent permitted by law, you voluntarily assume all risks associated with using FlightX and with participating in skydiving, parachuting, canopy flight, canopy piloting, high-performance canopy flight and swooping, including risks arising from relying on or misinterpreting FlightX content and from uploading, importing, reviewing or acting upon jump data.
To the maximum extent permitted by law, you release and discharge FlightX, Equipoised Enterprises Pty Ltd, and its directors, officers, employees, contractors, developers, coaches, advisors, shareholders, agents, licensors, service providers, affiliates, successors and assigns from any claim, demand, action, proceeding, loss, damage, injury, death, cost or expense arising from or connected with your use of FlightX or your participation in skydiving or related activities. This release does not exclude liability that cannot lawfully be excluded.
To the maximum extent permitted by law, FlightX and Equipoised Enterprises Pty Ltd are not liable for personal injury; death; property damage; economic loss; loss of data, opportunity, profits, reputation or training time; competition, equipment or travel losses; consequential, indirect, special or punitive damages; or claims arising from reliance on app content, sensor error, AI output, third-party services, user decisions, or skydiving and related activities.
Where liability cannot be excluded, FlightX's liability is limited, to the maximum extent permitted by law, to re-supplying the service, paying the cost of re-supplying the service, or refunding the amount you paid for the relevant service during the period giving rise to the claim.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or protection that cannot be excluded, restricted or modified under the Australian Consumer Law or any other applicable law. Where permitted, FlightX limits its liability to the maximum extent allowed. For recreational services, certain liability for personal injury or death may be excluded, restricted or modified where the law allows and required risk-warning and waiver requirements are satisfied. You acknowledge that you have been given a clear risk warning about the dangerous nature of skydiving, parachuting, canopy flight and related activities.
If you access FlightX from the United States, you acknowledge that liability waivers vary by state and that some states do not allow certain exclusions — nothing in these Terms excludes liability that cannot be excluded under applicable state law, including (where applicable) gross negligence, reckless conduct, intentional misconduct or statutory violations. If you access FlightX outside Australia, you are responsible for complying with your local laws and parachuting rules; FlightX does not represent that the app is suitable, lawful, approved or certified in every country. The releases, waivers and limitations in these Terms apply to the fullest lawful extent in your jurisdiction.
To the maximum extent permitted by law, you agree to indemnify and hold harmless FlightX, Equipoised Enterprises Pty Ltd, and its directors, officers, employees, contractors, developers, advisors, agents, licensors, affiliates and service providers against any claim, demand, liability, loss, damage, cost or expense (including reasonable legal fees) arising from: your use or misuse of FlightX; your breach of these Terms; your participation in skydiving or related activities; your reliance on FlightX information; your violation of law, drop zone or governing body rules, or manufacturer instructions; your uploaded data and shared content; your coaching or advice to another person; your use of FlightX in connection with another person's training, safety, equipment or performance; or any third-party claim arising from your conduct. This indemnity does not apply to the extent prohibited by law.
FlightX may use automated systems, algorithmic analysis, machine learning or artificial intelligence to generate content. AI output may be inaccurate, incomplete, may misinterpret data, may fail to detect dangerous behaviour, and may not account for local conditions, your full training history, your equipment condition or real-time factors. AI output must be reviewed critically and must not be treated as professional instruction. You are solely responsible for deciding whether and how to use any AI-assisted information.
FlightX may include beta, experimental, prototype, early-access or test features — including TrueAlt, sensor fusion, AI debriefs, Coach Apex, GPS auto-recording, phase detection, canopy and swoop analytics, FlySight imports, wearable and Garmin integrations, Bluetooth streaming, competition scoring, gate analysis, 3D replay and automated progression recommendations. Beta features may be unstable, inaccurate or incomplete; you must not rely on them for safety-critical decisions. FlightX may modify, suspend or remove such features at any time.
Use of FlightX does not create a coach-student, instructor-student, rigger-client, doctor-patient, lawyer-client, aviation authority-participant or fiduciary relationship between you and FlightX. Any relationship you have with a human instructor, coach, rigger, drop zone or governing body is separate from FlightX.
You must be at least 18 years old to create a FlightX account unless your parent or legal guardian reviews and accepts these Terms on your behalf, accepts responsibility for your use of FlightX, acknowledges the risks of skydiving and canopy flight, and confirms that FlightX is not responsible for supervising you. FlightX may refuse access to any user at its discretion where permitted by law.
FlightX may suspend, restrict or terminate your account if it reasonably believes you breached these Terms, misused the app, uploaded false data, created a safety risk, harassed another user, infringed rights, attempted to bypass security, or engaged in conduct that may expose FlightX or others to legal, safety or reputational risk. FlightX may discontinue or modify the app at any time.
FlightX — including its name, logo, design, software, source code, user interface, educational framework (including the CFX progression), analytics presentation, graphics, branding, copy, templates, databases and content — is owned by or licensed to Equipoised Enterprises Pty Ltd. You are granted a limited, revocable, non-exclusive, non-transferable licence to use FlightX for personal, lawful purposes in accordance with these Terms. You must not copy, reproduce, modify, distribute, sell, reverse engineer, scrape, extract, decompile or create derivative works except as permitted by law or as expressly permitted by an open-source licence covering a component of FlightX (see the Third-Party and Open-Source Software section). This restriction applies to FlightX's own proprietary code and content and does not apply to any open-source component, which remains governed by its own licence.
You retain ownership of content and data you upload. You grant FlightX a worldwide, non-exclusive, royalty-free licence to host, store, process, analyse, display, reproduce, modify for formatting, transmit and use your content and data to: provide FlightX services; display your logbook; generate analytics and debriefs; sync your account; support safety, debugging and app improvement; develop anonymised or aggregated insights; enforce these Terms; and comply with law. Personal information is handled in accordance with the FlightX Privacy Policy.
Your use of FlightX is also governed by the FlightX Privacy Policy. FlightX may collect account, device, GPS, altitude, sensor, jump, canopy, equipment and usage data, uploaded files, crash logs, support communications, and payment information via third-party processors. Skydiving data may reveal sensitive patterns, locations, behaviour, training history and performance — consider this before uploading or sharing.
FlightX uses reasonable efforts to protect data but does not guarantee data will never be lost, corrupted, deleted, delayed or unavailable. Maintain your own backups of important information. FlightX is not liable for data loss to the maximum extent permitted by law.
If FlightX offers paid subscriptions or premium features, pricing and payment terms are displayed before purchase. Payments may be processed by third-party app stores or payment providers. Refunds are subject to applicable law, app store rules and FlightX's refund policy. FlightX may change pricing, features or tiers with notice where required by law.
FlightX may update these Terms from time to time. Where required by law, FlightX will provide notice of material changes. Continued use after updated Terms take effect means you accept them; if you do not agree, you must stop using FlightX.
These Terms are governed by the laws of South Australia, Australia, unless mandatory laws in your location require otherwise. The parties submit to the courts of South Australia and any courts entitled to hear appeals from them. Where a consumer protection law gives you mandatory rights in another jurisdiction, nothing in this clause limits those rights.
Before commencing formal legal proceedings, you agree to contact FlightX at hello@flightxapp.com with reasonable details of your dispute, and the parties agree to attempt to resolve it in good faith. Nothing prevents either party from seeking urgent injunctive relief or exercising rights that cannot be limited by law.
If any part of these Terms is invalid, unlawful or unenforceable, it will be severed or read down to the minimum extent necessary and the remainder continues in effect. These Terms, together with the Privacy Policy and any additional feature-specific terms, form the entire agreement between you and FlightX regarding the app.
By ticking the acknowledgement boxes and tapping "I Agree" (or by creating an account or using FlightX), you confirm that: you have read and understood these Terms; you understand that skydiving, parachuting, canopy flight and related activities can cause serious injury or death; you understand FlightX is an educational, logging, review and information tool only — not an instructor, coach, altimeter, safety device, aviation instrument or emergency device; you understand FlightX data, GPS, altitude, sensor fusion, AI output and analytics may be inaccurate; you will not rely on FlightX for real-time safety-critical decisions; you will follow your instructors, coaches, drop zone, governing body, civil aviation authority and manufacturer guidance; you voluntarily accept the risks of skydiving and canopy flight; you agree to release, waive and limit claims against FlightX to the maximum extent permitted by law; and you agree to be bound by these Terms.
Your acceptance is recorded with your account ID, email, the Terms version, the state of each acknowledgement box, and a timestamp.
